Terms and conditions of sale for products sold on cendrier-club.com
Last updated: 27/10/2021
Article 1 - Purpose
These terms govern sales by Sisibo SRL, which operates Cendrier Club.
Article 2 - Prices
Our product prices are shown in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise stated. Standard delivery is free, with no minimum purchase, for the destinations we serve. Any paid delivery options are shown before you confirm your order.
If you order to a country other than mainland France, you are the importer of the products concerned. Customs duties or other local taxes, import duties or state taxes may be payable. These duties and amounts are outside the control of Cendrier Club. They are at your expense and are entirely your responsibility, both for declarations and for payments to the competent authorities and bodies of your country. We advise you to find out about these matters from your local authorities.
All orders, whatever their origin, are payable in euros.
Cendrier Club reserves the right to change its prices at any time, but the product will be invoiced at the price in force when the order is confirmed, subject to availability.
The products remain the property of Cendrier Club until the price has been paid in full.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage passes to you.
Article 3 - Orders
You can place an order online at cendrier-club.com
Contractual information is presented in French and will be confirmed at the latest when you confirm your order.
Cendrier Club reserves the right not to record a payment and not to confirm an order for any reason, and in particular in the event of a supply problem or a difficulty with the order received.
Products cannot be collected from our warehouses.
Article 4 - Order confirmation
Any order placed on the cendrier-club.com website implies acceptance of these General Terms. Any order confirmation constitutes your full and unreserved acceptance of these general terms and conditions of sale, without exception.
All the data provided and the recorded confirmation will serve as proof of the transaction.
You declare that you are fully aware of them.
Order confirmation will constitute signature and acceptance of the transactions carried out.
A summary of your order information and of these General Terms will be sent to you in PDF format to the email address used for your order confirmation.
Article 5 - Payment
By confirming your order, you are obliged to pay the price indicated.
Payment for your purchases is made by bank card through the secure Stripe system or PayPal.
Your card is only charged when the order is shipped. In the case of split deliveries, only the products shipped are charged.
Article 6 - Right of withdrawal
In accordance with article L.121-21 of the French Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal, without having to give a reason or pay a penalty.
Any returned item must be in new condition, with no trace of wear, assembly, ash or dirt, in its original state and complete (packaging, accessories, instructions).
If these conditions are met, you may then request an exchange or a refund. If not, the return will be refused and you will have to pay the reshipping costs so that we can send the product back to you.
You are liable in this respect. Any damage to the product in this context may defeat the right of withdrawal.
Return costs remain at the customer's expense.
If you exercise your right of withdrawal, Cendrier Club will refund the amounts paid within 14 days of receiving the product, using the same payment method as the one used for the order.
In the case of a refund following payment in instalments, a 5% penalty corresponding to handling fees will be applied.
No cash-on-delivery shipments will be accepted, whatever the reason.
For any return, whether the carrier is appointed by Cendrier Club or chosen by the Customer, responsibility for the return and for the returned goods lies with the Customer. Under no circumstances can Cendrier Club be held liable for any loss or damage occurring in transit, or if the product returned by the customer and received by Cendrier Club does not comply.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:
- The supply of services fully performed before the end of the withdrawal period, where performance began with the consumer's prior express agreement and express waiver of their right of withdrawal.
- The supply of goods or services whose price depends on fluctuations in the financial market beyond the trader's control, which may occur during the withdrawal period.
- The supply of goods made to the consumer's specifications or clearly personalised.
- The supply of goods liable to deteriorate or expire rapidly.
- The supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.
- The supply of goods which, after delivery and by their nature, are inseparably mixed with other items.
- The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose agreed value at the conclusion of the contract depends on market fluctuations beyond the trader's control.
- The supply of audio or video recordings or computer software that have been unsealed by the consumer after delivery, or for which a state refund procedure has been requested.
- The supply of a newspaper, periodical or magazine, except for subscription contracts for these publications.
- Transactions concluded at a public auction.
- The supply of digital content not supplied on a tangible medium, where performance began with the consumer's prior express agreement and express waiver of their right of withdrawal.
Article 7 - Availability
Our products are offered as long as they are visible on the cendrier-club.com site and while stocks last. For products that are not held in stock, our offers are valid subject to availability from our suppliers.
If a product is unavailable after you place your order, we will inform you by email. Your order will be automatically cancelled and no bank debit will be made.
In addition, the cendrier-club.com website is not intended to sell its products in large quantities. Cendrier Club therefore reserves the right to refuse orders of more than 10 identical items.
Article 8 - Delivery
Products are delivered to the delivery address given during checkout, within the time indicated on the order confirmation page.
The buyer is informed by email of the different stages of order tracking: preparation and delivery.
Preparation and transit times vary depending on the product, its availability, the destination and the carrier. The delivery information available is provided at checkout and in your order tracking. For any question about your order, contact our customer service at info@cendrier-club.com.
If shipping is delayed, we will email you to let you know of any impact on the delivery time we gave you.
In accordance with the law, in the event of a late delivery, as defined in article L 138-1 of the French Consumer Code, you may cancel the order under the conditions and procedures set out in article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will refund it, together with the shipping costs, under the conditions of article L 138-3 of the French Consumer Code.
If the parcel is damaged, you should try to note a reservation when you receive it.
In the case of minor damage (scratches, dents), you can contact Cendrier Club through the following link with supporting evidence. We will do our best to find the most suitable solution.
If compensation is refused, return costs will be borne by the customer.
For deliveries by a carrier, Cendrier Club cannot be held responsible for a delivery delay caused solely by the customer's unavailability after several appointment proposals.
If your parcel is lost or not received, please contact us as soon as possible in the event of an unusually long wait. We will check your parcel manually in order to find the best solution.
Article 9 - Warranty
All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 1641 et seq. of the French Civil Code. If a product sold does not conform, it may be returned, exchanged or refunded.
All claims and requests for exchange or refund under the warranty must be made by email or post within 30 days of delivery.
Products must be returned to us in the condition in which you received them, with all their components (seals, accessories, packaging, instructions, etc.).
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in article 6.
Under article L217-9 of the French Consumer Code: “In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods.”
However, the seller may decline the buyer's choice if it entails a cost that is disproportionate compared with the other option, taking into account the value of the goods or the seriousness of the defect. The seller is then required, unless impossible, to proceed with the option not chosen by the buyer.
Under article L217-10 of the French Consumer Code: “If repair and replacement of the goods are impossible, the buyer may return the goods and have the price refunded, or keep the goods and have part of the price returned.”
Finally, each warranty applies only to the first owner of the product.
Article 10 - Liability
The products offered comply with the French legislation in force. Cendrier Club cannot be held liable for any failure to comply with the legislation of the country to which the product is delivered. It is your responsibility to check with the local authorities whether the products or services you plan to order may be imported or used.
Furthermore, Cendrier Club cannot be held responsible for damage resulting from misuse of the product purchased.
Finally, Cendrier Club cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a service interruption, external intrusion or the presence of computer viruses.
Article 11 - Governing law in the event of disputes
The language of this contract is French. These terms of sale are governed by French law. In the event of a dispute, the French courts will have sole jurisdiction.
Article 12 - Intellectual property
All elements of the cendrier-club.com site are and remain the exclusive intellectual property of Cendrier Club. No one is authorised to reproduce, exploit, redistribute or use in any way, even partially, any elements of the site, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written agreement of Cendrier Club.
Article 13 - Personal data
Cendrier Club reserves the right to collect personal and identifying information about you. It is necessary for managing your order and for improving the services and information we send you.
It may also be passed on to companies that contribute to these relationships, such as those responsible for carrying out services and orders, for their management, performance, processing and payment.
This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the law of 6 January 1978, you have a right of access, rectification and objection regarding your personal and identifying data, directly on the website.
Article 14 - Archiving and evidence
Cendrier Club will archive order forms and invoices on a reliable and durable medium constituting a faithful copy, in accordance with article 1348 of the French Civil Code.
Cendrier Club's computerised records will be considered by all parties concerned as proof of the communications, orders, payments and transactions that took place between the parties.
